By downloading, installing, or using the NexFuel mobile application or visiting the NexFuel website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is provided by NexVantage Pty Ltd ("we", "our", or "us"), based in Sydney, Australia. If you do not agree to these Terms, do not use the Service.

2. Description of Service

NexFuel is a fuel price comparison and prediction application that provides users with real-time fuel pricing data, AI-generated price predictions, and route-based fuel station recommendations across Australia.

3. Accuracy of Information

While we strive to provide accurate and up-to-date fuel pricing information, we do not guarantee the accuracy, completeness, or timeliness of any data displayed in the Service. AI-generated predictions are estimates only and should not be relied upon as financial advice.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble any portion of the Service
  • Scrape, harvest, or collect data from the Service by automated means
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity
  • Use the Service while operating a motor vehicle

5. Intellectual Property

All content, features, and functionality of the Service are the exclusive property of NexVantage Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws.

6. Advertisements

The Service may display advertisements provided by third-party ad networks, including Google AdMob. We are not responsible for the content of third-party advertisements.

7. Limitation of Liability

To the maximum extent permitted by Australian law, NexVantage Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

  • Your use of or inability to use the Service
  • Any inaccuracy in fuel pricing data or predictions
  • Any decisions made based on information provided by the Service
  • Unauthorised access to or alteration of your data
  • Any third-party content or advertisements displayed within the Service

8. Indemnification

You agree to indemnify and hold harmless NexVantage Pty Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

9. Modifications

We reserve the right to modify or discontinue the Service at any time without notice. We may also update these Terms from time to time.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia.
